How Many Days is the Return Period (Right of Withdrawal)?
In distance contracts for the sale of goods, the buyer has the right to withdraw from the contract by rejecting the goods without any legal and criminal liability and without any justification within fourteen days from the date of receipt of the goods. In distance contracts for the provision of services, this period starts on the date the contract is signed. If it is agreed in the contract that the performance of the service will be made before the expiration of the fourteen-day period, the consumer may exercise the right of withdrawal until the date of performance. The costs arising from the exercise of the right of withdrawal belong to the seller.
In order to exercise the right of withdrawal, the Buyer must notify the Seller within the fourteen-day period by fax, telephone or electronic mail notified above and the goods / services must be within the framework of the provisions of Article 4 of the Distance Sales Agreement and in accordance with the preliminary information published on the website www.hukukfuar.com, which is an integral part of this Agreement and published on the website www.hukukfuar.com, the packaging and content must be undamaged and the Seller must be able to offer it for sale again. The return procedures within the scope of the Right of Withdrawal are included in the Distance Sales Contract. If this right is exercised, it is obligatory to return the original invoice for the goods / services delivered to the 3rd person or the Buyer. The cost of the goods / service and delivery costs are returned to the Buyer within 14 (fourteen) days at the latest following the receipt of the notice of the right of withdrawal, and the buyer is obliged to return the goods / service within 10 (ten) days. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded to the Buyer.
If there is a decrease in the value of the goods due to the fault of the Buyer or if the return becomes impossible, the Buyer is obliged to compensate the Seller’s damages in proportion to the fault. Payments can be made by credit card, EFT or money order.
Products for which the Right of Withdrawal cannot be exercised
Goods/services that cannot be returned due to their nature are goods/services that deteriorate rapidly and expire, disposable goods/services, all kinds of software and programs that can be copied. In addition, in order to exercise the right of withdrawal in all kinds of software and programs, DVD, DIVX, VCD, CD, CD, MD, videocassettes, computer and stationery consumables (toner, cartridge, ribbon and similar) and cosmetic materials, the packaging of the goods / services must be unopened, intact and unused.
(A) Contracts for goods or services whose prices fluctuate with fluctuations in financial markets and are not under the control of the seller or provider.
(B) Contracts for goods tailored to the consumer’s wishes or personal needs.
(C) Contracts for the delivery of perishable or expired goods.
Contracts for the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; contracts for the delivery of goods whose return is not suitable in terms of health and hygiene.
(D) Contracts for goods that are mixed with other products after delivery and cannot be separated due to their nature.
(E) Contracts for books, digital content and computer consumables provided in material media if the protective elements such as packaging, tape, seal, package are opened after the delivery of the goods.
(F) Contracts for the delivery of periodicals such as newspapers and magazines, other than those provided under a subscription agreement.
(G) Contracts for accommodation, transportation of goods, car rental, provision of food and beverages, and leisure time for entertainment or recreation, which must be concluded on a specific date or period.
(Ğ) Contracts for services performed instantly in electronic media or contracts for intangible goods delivered instantly to the consumer.
(H) Contracts for services that are started to be performed with the consent of the consumer before the expiration of the right of withdrawal period.
How do I return it?
Before sending the product to us, you must inform us of your return request by filling out the product return form on this page. After you have been notified by our technical department about the return, please fill in the return form that comes with the package and send the product to us with a Cargo company you trust. Confirmation information will be notified to you by phone or e-mail. The cost of the shipments made with cargo companies belongs to the sender. Counter-paid shipments will not be accepted. If the products received by us are delivered in accordance with the return conditions, the refund of the product amounts will be processed on the day the product reaches us. Which products can be returned? The originality, hygiene and resalability of the product must be preserved. For this reason, we cannot take back products with damaged product packaging, products whose packaging has been opened, used, destroyed and similar situations.
